Pegasus Group represented clients at a Section 78 appeal regarding the development of up to 118 dwellings on a site adjacent to the settlement boundary of the Infill Village of Sandford. Pegasus Group demonstrated that the Council was unable to demonstrate a five year supply of deliverable housing sites and that as such policies relevant to the supply of housing should not be considered up-to-date. This included Policies CS14 and CS33 which restrict development outside the settlement boundaries of Infill Villages.
Pegasus Group demonstrated that there were no adverse impacts which significantly and demonstrably outweighed the benefits. The benefits of much needed housing development at the sustainable settlement of Sandford were supported by the existence of employment opportunities within the village and the good access to other higher order settlements by public transport routes.
The appeal decision was released on 12th September 2016 in which the Inspector supported the conclusions of Pegasus Group and allowed the appeal, such that permission was granted.
